SMS/Text Messaging Terms

Depending on your relationship with Attuned ABA and the consent you have provided, messages may include communications concerning:

• Responses to inquiries;
• ABA service inquiries;
• Intake and onboarding;
• Eligibility or insurance-related information;
• Requests for documents or additional information;
• Appointment or assessment scheduling;
• Appointment reminders;
• Service scheduling and coordination;
• Administrative updates;
• Follow-up communications;
• Client or caregiver communications;
• Notifications regarding requested services; and
• Other communications related to your relationship with Attuned ABA.

Your consent to receive SMS communications is voluntary.

Where required, Attuned ABA will obtain appropriate consent before sending SMS communications.

Message frequency varies based on your interactions with Attuned ABA, the services you request or receive, and the nature of the communications.

Message and data rates may apply.

Your wireless carrier's standard messaging and data charges may apply to messages sent or received. You are responsible for charges imposed by your mobile carrier.

You may withdraw your consent and opt out of SMS communications at any time.

To stop receiving text messages, reply STOP to a message from Attuned ABA.

You may also communicate your request to stop receiving SMS communications through another reasonable method, including by contacting Attuned ABA directly.

After we receive and process an opt-out request, you may receive a final confirmation message informing you that you have been unsubscribed.

We will honor valid opt-out requests within the time required by applicable law.

After opting out, you will no longer receive SMS messages covered by your withdrawal of consent unless you subsequently provide consent again.

Opting out of SMS communications does not prevent Attuned ABA from communicating with you through other appropriate channels, such as telephone, email, mail, a secure patient portal, or another method, where permitted.

Attuned ABA respects the privacy of your mobile information.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Attuned ABA does not sell or rent mobile telephone numbers, SMS opt-in information, or SMS consent information to third parties for their own marketing or promotional purposes.

Information may be shared with subcontractors and service providers that support Attuned ABA's operations and communications, such as telecommunications providers, messaging platforms, customer service providers, and technology vendors, solely as necessary to perform services on Attuned ABA's behalf.

Text messaging originator opt-in data and consent will not be shared with third parties for their own marketing purposes.

SMS text messaging may not always provide the same level of security as a secure healthcare communications platform.

Please do not send highly sensitive health information, medical records, Social Security numbers, financial information, or other highly sensitive personal information through standard text messaging unless Attuned ABA has specifically instructed you that the communication method is appropriate and secure for that purpose.

Where communications involve Protected Health Information subject to HIPAA, Attuned ABA will handle that information in accordance with applicable law and its Notice of Privacy Practices.

Wireless carriers are not responsible for delayed or undelivered messages.

Delivery of SMS communications may be affected by your mobile carrier, device, network availability, service interruptions, or other circumstances outside Attuned ABA's control.

Attuned ABA does not guarantee that every SMS message will be delivered or received.

By enrolling in SMS communications, you represent that:

• You are authorized to use the mobile number provided;
• You are authorized to consent to communications at that number; and
• The information you provide is accurate.

If your mobile number changes or is reassigned to another person, you agree to notify Attuned ABA or opt out of SMS communications associated with the former number.

Attuned ABA may update these SMS Terms from time to time to reflect changes in our messaging practices, services, or applicable law.

Updates will be posted as part of our Terms and Conditions or otherwise made available as appropriate.
